About "CreativeML Open RAIL-M" License

Hello, thank you for releasing this amazing model.
I have a question regarding the license for the Illustrious-XL-v2.0 model.

The Illustrious-XL-v2.0 model is currently licensed under the CreativeML Open RAIL-M license, which was primarily used for Stable Diffusion 1.x models.

However, the SDXL_base-1.0 model — which Illustrious-XL-v2.0 seems to be based on — uses the CreativeML Open RAIL++-M license instead.
There is a key difference between these two licenses, particularly regarding the “remote update rights for derivative models and their outputs.”

  • CreativeML Open RAIL-M (SD1)

    Section IV: OTHER PROVISIONS
    7. Updates and Runtime Restrictions. To the maximum extent permitted by law, Licensor reserves the right to restrict (remotely or otherwise) usage of the Model in violation of this License, update the Model through electronic means, or modify the Output of the Model based on updates.

  • CreativeML Open RAIL++-M (SDXL)

    Section IV: OTHER PROVISIONS

My questions are:

  1. Is CreativeML Open RAIL-M indeed the intended license for Illustrious-XL-v2.0 (and not CreativeML Open RAIL++-M)?
  2. When creating a derivative model based on Illustrious-XL-v2.0, should we inherit the CreativeML Open RAIL-M license as well?
